THE 3rd NATIONAL VIRTUAL MOOT COURT COMPETITION, 2022
1. The Republic of Parlemento is the largest democracy in the world with a population of around 140 crores.
2. The Republic of Parlemento consists of people from different strata of the society, people from different religions, people from different educational and financial backgrounds, etc. The Republic of Parlemento is thus, a secular, socialist, economic and a democratic nation.
3. In the International Nation’s Organisation, almost all the countries of the world are member nations and the Republic of Parlemento in recent times has gained public popularity in the said organisation, thereby boosting the economy and the image of the country, on an international platform.
4. During 2020, the entire world was affected by Covid-19 pandemic and during the said period digital transactions increased manifold. Digital assets have been on the rise in the recent times.
5.The Republic of Parlemento did not enact any law to legalise the framework of digital assets, digital currency, non-fungible tokens (NFTs) etc. An attempt to ban these form of digital currency or assets was set aside by the Hon’ble Supreme Court of the Republic of Parlemento. While the Government continues to contemplate its stance on cryptocurrencies and NFTs, it has, in the interim, implemented a new tax regime aimed at taxing gains and, or, income from virtual digital assets @ 30%.
6. That the citizens of the nation were perplexed as to when there is no law legalizing the digital currency, digital assets, NFTs etc., the decision to tax gains from the same is unreasonable.
7. Thereafter, various citizens filed SLPs before the Hon’ble Supreme Court challenging the insertion of the new S. 115 BBH in the Income Tax Act. The
Hon’ble Supreme Court posted the said challenge to the aforementioned section for final hearing on the issues raised hereunder:
a. Whether or not the Government is justified in taxing digital currency,
digital assets, NFTs etc., which is not legalized?
b. Whether or not S.115BBH Income Tax Act is violative of the
Constitution of India?
8. The laws of Republic of Parlemento are in pari materia with that of the Union of India.
Rules for the Competition:
1. Two students from a law college are eligible to form a team for the purpose of participating in this competition. One college can send a maximum of 2 teams.
2. Team shall not comprise of a researcher, thus, both the team members are speakers.
3. Teams shall be known by the names of students alphabetically, for instance, if two students i.e., Mr. Suresh Rana of X Law College, Hyderabad and Ms. Padmavathi Rathore of X Law College, Hyderabad choose to form a team, then, the team code shall be Ms. Padmavathi Rathore and Mr. Suresh Rana. Alphabetically meaning P preceded S in the example.
4. Students of all years of the Five year and Three year law courses are eligible to participate in this Competition.
5. Registration Fees- Rs.500/-; The said amount can be paid via Googlepay on +91 7652095061. Incase the students want to pay the fees to a bank account, an email requesting details to be sent.
6. It is mandatory to send in the acceptance email through the official email Ids of the colleges or through Moot Court Society Email Ids, however acceptance emails can be sent through the personal email id of any team member incase the college does not have any such society.
7. A mail with the team code agreeing to participate in the said competition shall be sent on or before 20/11/2022 after paying the registration fees. The said email must provide the postal addresses with pincodes of both the team members, mobile numbers of both the team members, Scanned Copy of College ID Card of both the team members.
8. For all further correspondences the teams shall communicate using the email Id used for sending the confirmation email and no communication from new Email Ids will be entertained.
9. Each speaker shall speak for 15 minutes subject to extension granted by the judges.
10. The link for the competition will be sent to the email ids from which the soft copy of the memorials are sent.
11. Competition will be held on 17/12/2022 & 18/12/2022. A short Inauguration ceremony shall take place on 17/12/2022 which shall be attended by all participants without fail.
12. Steady internet connection to be maintained.
13. Cameras to be turned on at all times during the rounds.
14. Compendiums to be sent online only by 13/12/2022 on or before 5 pm.
15. Breach of deadlines shall entail disqualification.
16. In case during the rounds if there is any internet interruption from the side of the participant, then, a 5 minutes extension only will be granted, subject to the discretion of the judge.
17. Feedback after the rounds shall be provided.
18. All clarifications sought to be sent on or before 30/11/2022.
19. Dress Code for Men: White Shirt, Black or Grey Blazer, Black or Grey formal pants. Dress Code for Women: White Salwar Kameez with dupatta or White Shirt, Black or Grey Blazer, Black or Grey formal pants or skirt.
20. Failure to follow the dress code shall entail disqualification subject to the discretion of the Judge.

PROFILE OF THE CHIEF GUEST FOR THE INAUGURAL CEREMONY
HONOURABLE SRI JUSTICE (RETD.) THOTTATHIL B. RADHAKRISHNAN GARU
Thottathil B. Radhakrishnan was sworn-in as permanent Judge of the High Court of
Kerala on 14th October, 2004. He is the son of late N. Bhaskaran Nair and late K.
Parukutty Amma, both Advocates, who practised at Kollam.
Born on 29th April, 1959, he had his early schooling in St. Joseph's Convent and
Government Boys' High School, Kollam; Arya Central School, Thiruvananthapuram
and secured ISC conferred by the University of Cambridge (Local Examination
Syndicate), having studied in Trinity Lyceum, Kollam. After obtaining B.Sc. Degree in
Zoology from University of Kerala as a student of the Fatima Matha National College,
Kollam, he secured LL.B. Degree from Bangalore University having studied Law in
K.G.F. Law College, Kolar Gold Fields.
Enrolled on 11th December, 1983, he practised at Thiruvananthapuram as junior to
Advocate late P. Ramakrishna Pillai and thereafter shifted to High Court of Kerala in
1988 as junior to Senior Advocate late P. Sukumaran Nayar. He dealt with cases in
different branches of law, the areas of his prominent practice being Civil, Constitutional
and Administrative Law. He appeared also for various institutions including banks,
university and other public institutions. He also appeared for the High Court of Kerala.
He was appointed as amicus curiae in different matters and was Advocate-Member of
the Rule Committee constituted under Section 123 of the Code of Civil Procedure.
While an Advocate, he was invited as Resource Person by the Training Directorate
which later became the Kerala Judicial Academy. He also addressed various
programmes of Legal Services Authority and training programmes for Advocates.
As Judge, he was nominated by the Hon'ble Chief Justice to deal with original petitions
registered following directions of the Supreme Court in relation to mental health
matters. He was the President of the Board of Governors of Kerala State Mediation and
Conciliation Centre and the President of the Kerala Judicial Academy. On various
occasions, he was invited as Resource Person to the National Judicial Academy, Bhopal
and the Kerala Judicial Academy. He had also attended various national conferences on
different subjects of critical importance. He was the Executive Chairman of the Kerala
State Legal Services Authority, the Executive Chairman of the Lakshadweep State
Legal Services Authority, the Chairman of the Law Reporting Council, I.L.R. (Kerala
Series) and the President of the Rule Committee under Section 123 of the Code of Civil
Procedure. He was a Member of the Central Authority of the National Legal Services
Authority.
He was the Acting Chief Justice of the High Court of Kerala from 13.05.2016 to
1.8.2016 and from the afternoon of 16.02.2017 till he was sworn in as Chief Justice of
the Chhattisgarh High Court in the forenoon of 18.03.2017. He was the Chief Justice of
the Chhattisgarh High Court from 18.03.2017 to 06.07.2018. He was the Chancellor of
the Hidayatullah National Law University, Naya Raipur, Chhattishgarh.
He was sworn in as Chief Justice of the High Court of Judicature at Hyderabad for the
States of Telangana and Andhra Pradesh on 07.07.2018. He was the Chancellor of the
National Academy for Legal Studies and Research (NALSAR), University of Law,
Hyderabad and the Damodaram Sanjivayya National Law University, Visakhapatnam.
He was the Patron-in-Chief of the Telangana and Andhra Pradesh States Legal Services
Authority. He was the Chief Patron of the A.P. Judicial Academy, Secunderabad.
He was sworn-in as the Chief Justice of the High Court for the State of Telangana on
01.01.2019. He was the Patron-in-Chief of the Telangana State Legal Services
Authority. He was the Chief Patron of the Telangana State Judicial Academy,
Secunderabad. He continued to be the Chancellor of NALSAR, University of Law,
Hyderabad.
He has sworn in as Chief Justice of the High Court at Calcutta on 04.04.2019 and retired
on 28/04/2021.

His Lordship was born on 21.12.1969 at Kothagudem of erstwhile Khammam District in an agricultural family to Sri Mummineni Nageswara Rao and Smt. Late Bharatha Lakshmi, studied in Government School and Government Junior College at Cherla, Bhadradri-Kothagudem District and did graduation at Sir C.R.Reddy College, Eluru, West Godavari District. Thereafter, did active agriculture for a period of two years and then as per wish of his Lordship’s mother, joined LL.B. course at Nanded and completed his LL.B. in the year 1994 and enrolled as Advocate in the erstwhile Bar Council of Andhra Pradesh on 21.12.1994. While pursuing his LL.B. course, worked as Advocate Clerk in the office of Sri M.R.K.Chowdary, who happens to be his paternal uncle and joined in the chambers of Sri M.R.K.Chowdary after enrolment and continued in the office of Sri M.R.K.Chowdary till 2005 and became independent from the year 2005. A.Satyasiri is a practicing Advocate based in Hyderabad. After graduating from NALSAR University of Law (B.A.LLB Hons.), she has enrolled with the Bar Council of Andhra Pradesh (now Telangana) in June, 2015. Thereafter, she has obtained an LL.M from University of Pennsylvania Law School, specializing in areas of International Commercial Law and Alternate Dispute Resolution. MRS. MRUDULIKA CONCEPTA
An In-house counsel with broad experience in providing proactive counseling and
advise to major real estate companies on commercial leasing of both retail and office,
contract management, compliance management, title due-diligence, legal
documentation, lease management, legal risk management, mitigation and compliances.
As an in-house counsel, key roles include working closely with business and legal teams
in addressing legal requirements pertaining to negotiations and closures of legal
documentation. Skilled in strategic advisory to all levels of business, enterprise risk and
compliance, enforcement and protection of legal interests.
A masters in Arbitration law from Osmania University. Began her legal career as a
litigating lawyer at Thomas George & Associates, moved in-house with Asia’s largest
diversified real estate groups, CapitaLand Group (erstwhile Ascendas – Singbridge), incharge for the Legal Division for its Gurgaon and Hyderabad Operations. Thereafter,
moved into the young and vibrant real estate arm of Bharti Enterprises, Bharti Realty,
in its Legal Department responsible for its top quality properties in Delhi-NCR. Post
her stint at Bharti Realty, she has now joined India’s largest retail led mixed-use
developer, The Phoenix Mills, in its Legal Department.

Prior to joining TG&A, he interned under the guidance of the current Justice of Supreme
Court Hon’ble Justice Kurian Joseph wherein he gained the appreciation of the Hon’ble
Justice for his eminent research skills. He further interned with Retd. Hon’ble Justice
of High Court of Kerala and currently designated Senior Counsel of Supreme Court of
India R. Basant wherein he assisted in numerous cases and was highly appreciated for
his hard work and dedication. Manav Gecil Thomas interned with designated Senior
Counsel of the High Court at Hyderabad for the State of Telangana and for the State of
Andhra Pradesh (Late) Padmanabha Reddy where he had the fortune of observing the

The other newsletter, called "LawPrime" has passed 700 subscribers in 3 months and is purposely made to give legal updates from every country.
AYUSH SRIVASTAVA
He is a 2018 Graduate from ICFAI UNIVERSITY, Dehradun and diploma
holder in ADR from NALSAR University, Hyderabad.
Having almost 5 years of work experience, he started his journey with LPO in
Pune dealing with Foreign Tax Law. Because of his interest in Indian Law,
thereafter he joined Litigation chamber in Delhi High Court where he learned
the art of court craft from basic case filing of the matter till the arguments before
various district and high court of NCR and briefing senior Advocates like Mr.
Mukul Rohatgi, Mr. Ranjit Kapoor, Mr. Amit Sibbal, Mr. Sandeep Sethi and
many more.
Currently, He is working as a Associate with Link Legal in their
Arbitration/Litigation team. He has worked across various dimensions of
arbitration involving Infrastructure Arbitration, Energy Law Arbitration, Mining
Arbitration and many more. Before joining Link Legal, he was associated with

She is the currently working as a Junior Associate at Thomas George & Associates. She completed her B.A. LL.B. from PG College of Law, OU. She is currently appearing before the Hon’ble High Court for the state of Telangana and various Judicial and Non Judicial Fora.
SIMRAN SINGH
I hail from Nagpur Maharashtra and I graduated from ILS, Law College, Pune in the
year 2019. During my tenure at ILS, Law College, I also pursued a Diploma in
International Taxation and Corporate Laws and attended various workshops pertaining
to Alternate Dispute Resolution. Thereafter, I went on to pursue an LL.M. in
International Arbitration and Dispute Resolution from the National University of
Singapore in the year 2020.
In view of furthering my interest and learning in the given field, I joined the Chambers
of Hon’ble Justice Vijay C Daga, Former Judge of the Bombay High Court, as an
Associate. I worked under Justice Daga’s guidance for almost 2 years, specializing in
niche arbitration disputes.
Currently, I am a Dispute Resolution Associate at Tatva Legal, Hyderabad. My work
profile at Tatva is very litigation specific and involves appearing before various courts
in Hyderabad. Simultaneously, I also assist in complex arbitration disputes.
